Scope of declaration

(1) Resident enterprises that have been registered and established in the administrative area of our province for more than one year (365 calendar days) and meet the relevant conditions stipulated in Article 11 of the "Measures for Identification".

(2) Where the high-tech enterprises recognized by the Jiangsu Province high-tech enterprise certification Management coordination Group in 2020, and the high-tech enterprises recognized by the provincial (municipal) certification institutions in 2020 and relocated to Jiangsu Province within the validity period, according to the provisions of the "Identification Measures", the high-tech enterprise qualification will expire in 2023, If the enterprise needs to apply for recognition again, it shall be handled in accordance with the provisions of this notice.

2. Declaration time

High-tech enterprises do not set up the declaration batch, the enterprise can start to declare from the date of the release of this notice. Provincial high-tech enterprise identification management Coordination Group Office (hereinafter referred to as the "Coordination Group Office") to accept the high-tech enterprise application materials collected and reported by the district city, county (city, district), national and provincial high-tech zone science and technology departments of 18:00 on August 31. The deadline for submitting application materials to the local science and technology department shall be subject to the notice of the local science and technology department.

3. Declaration procedures

(1) Self-evaluation

Enterprises shall conduct self-evaluation against Article 11 of the Measures for Identification. If qualified, select an accounting firm or tax agent firm that meets the relevant provisions of Article 1 (3) of the "Work Guidelines" to conduct a special audit (authentication) of research and development expenses and income from high-tech products (services), and independently prepare and complete the application materials for the identification of high-tech enterprises in accordance with the "Identification Measures", "Work Guidelines" and the requirements of this notice. The term "bad record" as mentioned in paragraph 1 (3) of Article 1 of the Work Guidelines includes:

1. Administrative punishment by financial department and tax department due to practice;

2. Subject to self-disciplinary punishment (including admonishment, notification of criticism, public condemnation) by CPA industry organizations;

3. Subject to self-disciplinary punishment by tax agent industry organizations (including warning, notification criticism, public condemnation, failure in annual inspection, cancellation of membership);

4. Other bad records identified by the national high-tech enterprise management Leading group. Enterprises can visit the website of Chinese Institute of Certified Public Accountants (http://www.cicpa.org.cn) for information enquiry - Industry Management Information enquiry - Public enquiry column, and the website of China Association of Certified Tax Agents (http://www.cctaa.cn/) for information service platform of China Tax Association - Industry Management - Offices/Taxation Teacher query column, query the relevant intermediary institutions and practitioners and other information. Starting from October 1, 2022, all audit reports and other assurance reports issued by accounting firms, including financial statement audit reports, special audit reports, etc., the first page of the reports must contain the two-dimensional code and report code filed by the Unified Supervision platform for Certified Public Accountants of the Ministry of Finance (http://acc.mof.gov.cn/). Invoice for payment of audit report fees by the reporting enterprise for reference.

(2) Online declaration

1. In order to thoroughly implement the reform requirements of the provincial Party Committee and the provincial government on "discharge service" and provide facilitation services for enterprises, the declaration of high-tech enterprises in our province is carried out in the way of "One Netcom report", and enterprises only need to submit the declaration materials at one time in the "high-tech enterprise Identification Management System". Enterprises through the recognition of hi-tech enterprises management network (http://www.innocom.gov.cn) or the "science and technology department of government affairs service platform" (most url: fuwu. Gov. Cn), click on "user login" and complete the real-name authentication after login "the recognition of hi-tech enterprises management system". If the enterprise has not registered, click "Register", and log in after the registration information is approved (the original "high-tech enterprise identification Management network" registered users do not need to re-register, can log in with the original user name and password).

2. Enterprises log in to the "high-tech enterprise Identification Management System", enter the enterprise declaration system (enterprise account) - high enterprise identification declaration - new declaration materials, fill in the "high-tech enterprise Identification Application" as required, and provide the attached materials as required (specific material requirements see Annex 1, the original scan), submit the materials to the local science and technology department through the network. The main person in charge of the enterprise must carefully check the application materials filled in and uploaded to ensure that the materials are true and effective, clear and complete, signed and sealed. Secret-related enterprises shall, in accordance with the relevant provisions of the State on confidentiality, de-classify the declared materials on their own to ensure the security of secret-related information.

3. According to the relevant requirements of the "Notice of the Ministry of Science and Technology on the implementation of the Notification Commitment System for the Identification of Relevant Certification Matters of high-tech Enterprises" (State Technology Fire (2021) No. 362), the application materials of high-tech enterprises such as business licenses and enterprise registration certificates and patent certificates and other enterprise intellectual property documents shall implement the notification commitment system. Enterprises can independently choose whether to apply the notification commitment system. Details of proof, content of proof, effectiveness of commitment, responsibility for false commitment and verification power are set out in Annex 6. If you choose to apply the notification commitment system, the applicant has promised to know all the contents of the notification by the coordination group office, log in to the "high-tech enterprise Identification Management System", enter the enterprise declaration system (enterprise account) - high enterprise identification declaration - New declaration materials - Notification commitment system, check the box that you have read and agreed to the "Certificate Notification Commitment". "High-tech Enterprise Identification Management System" automatically generates the "Certificate Notification Commitment" (applicable to the application for high-tech enterprise identification) text with the applicant's name and other information, download and print (system default A4 paper, positive and negative printing). The applicant enterprise shall be signed by the legal representative of the enterprise and stamped with the official seal of the enterprise at the corresponding position of the Letter of Commitment for Notification of Certification Matters, and the signed and stamped Letter of Commitment for Notification of Certification Matters shall be scanned and uploaded to the "high-tech enterprise identification management system", and no longer need to provide the applicable certification materials. If it does not choose to apply the notification commitment system, the applicant enterprise shall provide the required certification materials for the relevant matters in accordance with the provisions.

(3) Local summary

1. Local science and technology departments shall guide enterprises to log in to the "high-tech enterprise Identification Management system" to fill in relevant data, handle the notification commitment system and upload attachments, and carry out on-site verification of the declared enterprises as required (see Annex 7 for on-site verification content). Enterprises that are found to be inconsistent with the declaration materials, have falsified practices or do not meet the declaration requirements during on-site verification shall not be recommended to report.

2. For the declaration enterprises that have passed the on-site verification, the local science and technology departments, together with the finance and tax departments, shall review the declaration materials submitted by the enterprises in the "high-tech Enterprise Identification Management System". Enterprises within the scope of the county (city) shall be examined and approved by the county (city) science and technology department in conjunction with the finance and taxation department; An enterprise within an urban area of a city divided into districts shall be examined and approved by the science and technology department of the city divided into districts in conjunction with the finance and taxation department. The enterprises collected and managed by the third tax Bureau of the Provincial tax Bureau shall be audited by Nanjing Science and Technology Bureau together with the municipal finance department and the third Tax Bureau of the Provincial Tax Bureau; The enterprises in the national and provincial high-tech zones shall be audited by the science and technology departments of the high-tech zones together with the finance and taxation departments. Local departments of science and technology, finance and taxation shall carry out audit work according to the following division of labor:

(1) Local science and technology departments are responsible for reviewing the intellectual property rights of the declared enterprises. According to the relevant provisions of the State, if the intellectual property rights of the newly declared enterprises are all authorized software Copyrights in the year of application, they do not meet the conditions for identification of high-tech enterprises, and local science and technology departments shall strengthen examination and verification, and shall not recommend and report enterprises with such circumstances; For enterprises that choose not to apply the notification commitment system, local science and technology departments shall conduct careful examination by reviewing the original intellectual property rights and verifying with relevant competent authorities of intellectual property rights; The local science and technology departments shall also issue opinions on whether major safety, major quality accidents or serious environmental violations have occurred within the previous year, and whether the enterprises meet the relevant requirements after on-site verification.

(2) Local financial departments issue opinions on whether accounting firms meet the requirements, and tax departments issue opinions on whether tax agent firms meet the requirements.

(3) Local tax departments shall compare the sales income and total income in the declaration materials with the data of the tax declaration system and issue opinions. After the above materials are confirmed by the relevant departments and meet the requirements, the local science and technology departments will submit the formally recommended enterprise declaration materials to the coordination group office through the network in the "high-tech enterprise identification management system", and the declaration materials will be automatically transmitted from the "high-tech enterprise identification management system" to the "high-tech enterprise management system of Jiangsu Province". After the completion of the transmission, local science and technology departments from the perspective of service reporting enterprises, the integrity of the declaration materials in the "Jiangsu high-tech Enterprise Management System" is reviewed, and enterprises are guided to improve the quality of declaration. After the completion of the audit, the Summary Table of Recommended high-tech Enterprises, Summary Table of Recommended Reporting of high-tech Enterprises' Intermediaries and Summary Review Table of the Validity of Intellectual Property Rights of Enterprises not applicable to the Notification Undertaking System shall be exported in the Jiangsu High-tech Enterprise Management System. The Summary Form of High-tech Enterprises recommended for Submission shall be stamped by the departments of science and technology, finance and taxation, the Summary Review Form of the Validity of Intellectual Property Rights of Enterprises not Applicable to the Notification Commitment System shall be stamped by the departments of science and technology, and the Summary Form of the Information of Intermediaries of high-tech Enterprises Recommended for Submission shall be stamped by the departments of finance and taxation.

(4) Submission of materials

Local science and technology departments shall issue formal letters of recommendation (see Attachment 2 for the template). The recommendation letter, the Summary Form of Recommended High-tech Enterprises, the Summary Form of Recommended High-tech Enterprises' Intermediary Institutions, and the Summary Review Form of the Validity of Intellectual Property Rights of Enterprises not applicable to the Notification Commitment System shall be made in one copy and submitted to Jiangsu Productivity Promotion Center (entrusted unit of the Coordination Group office). At the same time, the local science and technology department will scan and upload the above documents to the "high-tech enterprise management system of Jiangsu Province". After the office of the Coordination Group receives the above materials and verifies that they are correct, the expert review will be carried out in a timely manner. The science and technology, finance and taxation departments of the county (city) and provincial high-tech zones shall copy the Summary Form of Recommended High-Tech Enterprises to the science and technology, finance and taxation departments of the districted cities respectively.

4. Job requirements

(1) Local science and technology departments should actively carry out training for high enterprise declaration together with finance and taxation departments at the same level, strengthen the interpretation of policies related to high enterprise identification, guide enterprises to grasp the declaration conditions, improve the declaration materials, and improve the quality of declaration. In order to further optimize the services for the reporting enterprises, the coordination group office will carry out high enterprise reporting tour training for all districts and cities in the province in a combination of online and offline, improve the level of enterprise policy grasp, and solve the problems existing in the reporting process of enterprises. The science and technology departments of each district and city should take the initiative to coordinate the coordination group office to arrange the training work, and fully mobilize the application enterprises in the districts, counties (cities) and high-tech zones within the jurisdiction to participate. At the same time, local science and technology departments should strengthen the policy publicity such as the implementation of the notification commitment system for high-tech enterprises to identify relevant certification matters, do a good job in relevant information consultation, and actively promote and implement the notification commitment system for certification matters; Take the initiative to establish and improve the coordination mechanism for the work of high-tech enterprises together with the financial and tax departments at the same level to ensure the orderly implementation of the declaration work; Strengthen communication with emergency management, market supervision, ecological environment and other functional departments at the same level, and shall not recommend and report enterprises that have suffered major safety, major quality accidents or serious environmental violations within the year before the application for recognition; Strengthen the organic connection between the evaluation of science and technology smes and the identification of new and high-tech enterprises, focus on strengthening the guidance of science and technology smes that have passed the evaluation, give priority to recommending qualified science and technology smes to apply for new and high-tech enterprises, and further improve the quality of declaration; Do a solid job in enterprise innovation management services, increase policy implementation, and promote enterprise innovation and development.

(2) Local science and technology departments should conscientiously implement the spirit of the eight provisions of the Central Committee when organizing the declaration, According to the Party Group of the Provincial Department of Science and Technology, "Opinions on Further Strengthening the Comprehensive strict Party governance of the Province's science and technology Management System" (Suke Party Group [2018] No. 16), the Provincial Department of Science and Technology, "Notice on forwarding the Ministry of Science and Technology < Regulations on the Handling of entrusted behavior in the Review of Science and Technology activities (Trial) >" (Suke Supervision and Development [2021] No. 44) and the Provincial Department of Science and Technology on further strict The document requirements of the Notice on the identification and management of high-tech Enterprises (Suke Gaofa (2020) No. 203), strictly implement the relevant provisions of the "six commitments" and "eight strictly prohibited" of the province's science and technology management system, and deploy, implement and assess the construction of Party style and clean government and the reporting work of organizations. Effectively strengthen the prevention and control of the risk of clean government in key links and key posts, ensure the fairness and standardized operation of the declaration work, and resolutely eliminate the occurrence of "paid service" behavior, local science and technology departments shall not entrust or designate any unit, department and individual to prepare the declaration materials for the reporting enterprise, and shall not directly accept the materials submitted by non-reporting units. Local departments of science and technology, finance and taxation shall, in accordance with the requirements of this circular, do a good job in the examination, strengthen the sense of responsibility, do a good job in the examination, and prevent the examination from becoming a formality and going through the motions.

(3) The data and materials submitted by the enterprise in the "High-tech Enterprise Identification Management System" are the basis for subsequent formal review and expert review, and the enterprise shall prepare and submit the application materials in strict accordance with the relevant standards and requirements of the "Identification Measures" and the "Work Guidelines", and be responsible for the authenticity, effectiveness, integrity and legality of the application materials provided. Avoid misstatement and omission of materials. Enterprises must actively cooperate with the on-site verification and declaration materials review work, if the provision of false promises or there is fraud, once found and verified, the provincial high enterprise identification management coordination group will be in accordance with the "identification Measures" and "Jiangsu Province science and technology plan project credit management Measures" (Su science and technology regulation (2022) No. 3) of the relevant provisions of the processing and record bad credit records. For the intermediary agencies that have serious mistakes or fraud in their work, they will be announced on the "high-tech enterprise Identification and Management Work Network" in accordance with the relevant provisions of the "Work Guidelines" and the "Jiangsu Province Science and Technology Plan Project Credit Management Measures", and shall not participate in the relevant work of high-tech enterprise identification within three years from the date of announcement, and shall be recorded in the bad credit record.

(4) All localities should guide enterprises to reasonably arrange the declaration schedule to prevent network congestion caused by too much declaration. If the enterprise has any questions about the policies related to the identification and management of high-tech enterprises, please contact the coordination group office in time; If you encounter any problems in the use of the network system, please contact the provincial Productivity promotion Center in time; If you have any questions about the application and training arrangements, please contact the local science and technology authorities in time.
